'পিতামাতার ভরণপোষণ আইন ২০১৩'তে করা প্রথম মামলা

<< < (2/3) > >>

riaduzzaman:
Does it apply to female as well.

Ferdousi Begum:
Dear Riad sir, first of all, female ARE NOT BOUND TO GIVE MAINTENANCE to anyone, either husband or children or parents as well legally in BD. But question may occur in case of having only one daughter. Well, no precedent is there. Though I think in that case, the Court will decide the case as per every individual fact.

farzanamili:
I have a question...is this law applicable to a daughter who will not claim her inheritance right from parents? If you know, please throw light on this point.

anamika.law:
Hope this legislation will be very effective in the prospect of our family system.

Is this Act applicable to all religious communities in Bangladesh???

Ferdousi Begum:
First of all, this Act said about child, in terms of General Clauses Act child includes both male and female, then in terms of female you can say that our custom never binds them as well, though law is not specific in this regard, thirdly, if the parent has only one daughter, then what will happen? We know that, every Act has some problems in case of implementation, then only case-laws and the judgement given by the Court can help.

The Act is totally silent about them who did not take inheritance from their parent, I think in that case also you cannot avoid your responsibility.

This case is referred for all whether Muslim or Hindu or any other religion.
