Nature of Inheritance by Hindu Women

(1/3) > >>

anamika.law:
The nature of inheritance by Hindu women is of a peculiar kind. When a Hindu woman inherits to the property of a male or female she takes only a limited interest. As long as she is alive can consume the property without any kind of transfer to anyone except legal necessity.

After her death her own heir does not inherit that property but property goes to the next heir of the person from whom she inherited that property. So that a Hindu woman is always called a limited heir.

If we compare in this prospect the status of a Hindu woman in one side and a Muslim or Christian woman on the other side then what difference we can see?
Obviously Muslim or Christian woman inherits as full or absolute heir.

So what is the wrong here with a Hindu woman?

Why it is thought about a Hindu woman of being major and of sound mind will not be able to maintain her own property where a Muslim or Christian woman can do the same?
Is not it seems a meaningless peculiarity of Hindu system of inheritance which deprives Hindu women in this regard?

Till now this system is continuing in Bangladesh but the question is for how long this system would continue?

It's the high time and also crying  need of time to change this negative system of inheritance with enactment of proper statutory law and implementation of that law.

Nature of inheritance must be same for a Hindu male and a Hindu female which will in the long run add advantages to Hindu family law system.

Ferdousi Begum:
Actually it's an issue of great thinking, everybody fears a lot to create a new law as noone wants to conflict with the custom that prevails from time immemorial, but I think new law should be made in this regard.

anamika.law:
Demand of time is that new law must be made.

farzanamili:
Everybody fears CHANGE but CHANGE is the demand of time! When time changes, thinking, life-style, social values all change, so why not law? If old law cannot solve present problems, it must be changed.

riaduzzaman:
Critical thinking.
