Title: Life Imprisonment

Life Imprisonment is very confusing term among the students. Many students believe that life imprisonment means one has to stay in the prison for 30 years/ 20 years or 14 years. This notion is totally misnotion. When a person is punished with imprison for life that means he has to stay in the jail until demise. There is no provision in the Penal Code of Bangladesh that indicates that life imprison means 30 years,/20 years or 14 years. In section 57 of the Penal Code of Bangladesh, it is mentioned where there is question of fraction of punishment, then life imprison will be counted as 30 years that does not mean that after the expiration of 30 years the accused never be released from the prison; that  will mean only in case of fraction of punishment. For example section 511 of the Penal Code of Bangladesh provides that, Whoever attempts to commit an offence punishable by this Code with [ imprisonment for life] or imprisonment, or to cause such an offence to be committed, and in such attempt does any act towards the commission of the offence, shall, where no express provision is made by this Code for the punishment of such attempt, be punished with [ imprisonment of any description provided for the offence, for a term which may extend to one-half of the longest term of imprisonment provided for that offence], or with such fine as is provided for the offence, or with both.

In this case if a person attempts to commit an offense and the punishment of which is life imprisonment, the punishment will not exceed one half of the substantive imprisonment. Here the question fraction arises and only in this cases life imprison will be reckoned as 30 years that he has to suffer 15 years.

While teaching law of crimes, we should mention these points to clarify the matter.
