How well do you know Facebook terms and conditions?

Almost everyone who has access to internet has an account on Facebook. While signing up on Facebook, you have to agree to the terms and conditions offered by the social media. However, the users hardly care or take time to read the terms and conditions assuming it as a social version of all standard forms of contract. They might be proved wrong in certain circumstances.

Here are some provisions of the ‘Statement of Rights and Responsibilities’ offered by Facebook and by using or accessing Facebook, you agree to this Statement, which can be updated from time to time.

Registration and account security

Section 4 of the “Statement of Rights and Responsibilities” deals with registration and account security. It requires the users to provide their real names and information. Here are some commitments you make to Facebook relating to registering and maintaining the security of your account. You will not:

 Provide any false personal information on Facebook, or create an account for anyone other than yourself without permission
Create more than one personal account
Create another one without permission, if Facebook disables your account
Use your personal timeline primarily for your own commercial gain, and will use a Facebook Page for such purposes
Use Facebook if you are under 13
Use Facebook if you are a convicted sex offender
Share your password (or in the case of developers, your secret key), let anyone else access your account, or do anything else that might jeopardize the security of your account
Transfer your account (including any Page or application you administer) to anyone without first getting written permission from Facebook
Select a username or similar identifier for your account or page that closely relate to a user’s actual name, company, etc. Facebook reserves the right to remove or reclaim such name or identifier, if it believes it is appropriate
Your data will go and get processed in the US

Section 17 of the “Statement of Rights and Responsibilities” deals with the special provisions applicable to users outside the US. It says, “You consent to having your personal data transferred to and processed in the United States.”

Users of a country that is embargoed by the US

Section 17 also says that if you are located in a country embargoed by the United States, or are on the US Treasury Department’s list of Specially Designated Nationals you will not engage in commercial activities on Facebook (such as advertising or payments) or operate a Platform application or website. You will not use Facebook if you are prohibited from receiving products, services, or software originating from the United States.

Facebook Inc. or Facebook Ireland Ltd

Section 19 of the ‘Statement of Rights and Responsibilities’ says, “if you are a resident of or have your principal place of business in the US or Canada, this Statement is an agreement between you and Facebook, Inc.  Otherwise, this Statement is an agreement between you and Facebook Ireland Limited.”

Intellectual property rights

Section 2 deals with the intellectual property rights (patent, copyright, trademark etc) that you have over the contents you posted on Facebook. For content that is covered by intellectual property rights, like photos and videos, you specifically give Facebook the following permission, subject to your privacy and application settings: non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use any intellectual property content that you post on or in connection with Facebook.

Disputes

Section 16 says that, you will resolve any claim, cause of action or dispute you have with Facebook arising out of or relating to this Statement or Facebook exclusively in the US District Court for the Northern District of California or a state court located in San Mateo County, and you agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims. The laws of the State of California will govern any claim that might arise between you and Facebook, without regard to conflict of law provisions.
